I think its absolutely critical to this conversation to find the actual
case law backing up this assertion. Anything less is empty handwaving by
people who are not lawyers, and thus whose opinions don't matter, in
matters of law.

I honestly want to know, so that I can account for it in any future
licensing decisions I may make...
